Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ARC AI (“ARC AI,” “we,” “us,” or “our”), including our website at arcai.io, mobile interfaces, APIs, and all related services (collectively, the “Services”).

By creating an account, connecting a wallet, or otherwise accessing the Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

You must be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater) to use the Services.

You represent and warrant that: (a) you have the legal capacity to enter into these Terms; (b) you are not located in, or a national or resident of, any country or region subject to comprehensive sanctions by the United States, European Union, or United Kingdom; (c) you are not listed on any government sanctions list; and (d) your use of the Services complies with all applicable laws and regulations in your jurisdiction.

We reserve the right to restrict access to the Services in certain jurisdictions at our sole discretion.

Cryptocurrency markets are highly volatile and speculative. Past performance of any asset, signal, or analysis does not guarantee or predict future results. You may lose some or all of your investment in any cryptocurrency.

You acknowledge that: (a) you are solely responsible for all trading and investment decisions; (b) you should conduct your own independent research and due diligence before making any financial decision; (c) you should consult a licensed financial advisor before investing; and (d) ARC AI bears no responsibility for any financial loss you incur.

ARC AI uses artificial intelligence, machine learning, and algorithmic models to generate signals, risk scores, and market analysis. These outputs:

• Are probabilistic in nature and may be incorrect or incomplete.
• Are based on publicly available on-chain data, market data, and social signals which may be delayed, incomplete, or inaccurate.
• May not detect all fraudulent, manipulative, or scam tokens.
• Should not be the sole basis for any financial, security, or investment decision.
• Are not audited, certified, or validated by any regulatory body.

Scam probability scores, whale activity indicators, and AI-generated narratives are experimental tools. A low scam probability score does not mean a token is safe. A high score does not mean a token will perform well. Always verify information independently.

ARC AI offers tiered access to its Services:

• Free: Limited access to AI signals feed, basic token analysis, and public market data.
• Pro: Expanded signal limits, wallet intelligence, launch radar, and enhanced analysis.
• Elite: Maximum limits, API access, priority signal delivery, and advanced features.

We reserve the right to modify, suspend, or discontinue any feature or tier of the Services at any time without prior notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

Service availability is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or timely access to the Services.

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights.
• Engage in market manipulation, pump-and-dump schemes, wash trading, or any form of market abuse.
• Use AI signals or data to systematically mislead, defraud, or manipulate other investors.
• Scrape, crawl, or systematically extract data beyond what is permitted by your API plan.
• Reverse-engineer, decompile, or attempt to extract the source code of the Services.
• Resell, sublicense, or redistribute our data or signals without prior written consent.
• Attempt to circumvent rate limits, access controls, or authentication mechanisms.
• Introduce viruses, malware, or any harmful code into the Services.
• Impersonate ARC AI, its employees, or any other person or entity.
• Use the Services for any illegal purpose, including money laundering or sanctions evasion.

Violation of these restrictions may result in immediate termination of your access and, where appropriate, reporting to relevant authorities.

Access to the ARC AI API is available to Elite plan subscribers subject to rate limits and the following conditions:

• API keys are personal and non-transferable. You must not share or expose your API key publicly.
• You are responsible for all activity that occurs under your API key.
• API responses contain AI-generated data and carry all disclaimers set out in Section 4.
• Commercial use of API data to build competing services requires prior written consent.
• We reserve the right to revoke API access for abuse, excessive usage, or policy violations.

ARC AI uses wallet-based authentication. You connect to the platform by signing a cryptographic message with your wallet — no password is stored. By connecting your wallet:

• You confirm you are the rightful owner of the wallet address used.
• You accept that your public wallet address will be stored and associated with your account.
• You are responsible for securing your private keys. We never request or store private keys.
• We are not responsible for losses resulting from unauthorized access to your wallet.

All content, design, software, algorithms, and data on ARC AI — including but not limited to AI models, signal methodologies, scoring systems, and the platform interface — are the exclusive property of ARC AI and are protected by copyright, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial purposes. This license does not include the right to redistribute, sell, modify, create derivative works from, or commercially exploit any part of the Services.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

We do not warrant that: (a) the Services will be uninterrupted or error-free; (b) any signal, analysis, or data is accurate, complete, or up to date; (c) the Services are free of viruses or other harmful components; or (d) defects will be corrected.

Third-party data providers (including but not limited to CoinGecko, Helius, and on-chain data sources) may provide inaccurate or delayed data. We are not responsible for errors originating from third-party sources.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARC AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

• Trading or investment losses of any kind arising from use of, or reliance on, our Services.
• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Damages resulting from inaccurate AI signals, false scam scores, or missed alerts.
• Unauthorized access to or use of your account or wallet.

In no event shall our total liability to you for all claims exceed the greater of (a) the amount you paid to ARC AI in the 12 months prior to the claim or (b) USD $50.

You agree to indemnify, defend, and hold harmless ARC AI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit through the Services.

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violations of these Terms. Upon termination, your right to use the Services ceases immediately.

You may stop using the Services at any time. Sections 3, 4, 9, 10, 11, 12, and 14 of these Terms survive termination.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law.

You waive any right to participate in a class action lawsuit or class-wide arbitration against ARC AI to the fullest extent permitted by law.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the effective date above and, where appropriate, by in-app notification. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.
